<br />. <br /> <br />. <br /> <br />. <br /> <br />Resolution 565] <br />Page 2 <br /> <br />construction of a cul-de-sac as shown on attached exhibit "B'"; and, <br /> <br />WHEREAS. the City Council has reviewed the applicant's request for a minor <br />subdivision and has determined that it is in conformance with Chapters I 104. 1201, and 1202 of <br />the Municipal Code; and <br /> <br />WHEREAS, the City Council finds that the applicant's request for a minor subdivision is <br />in conformance with the Comprehcnsive Plan: and. <br /> <br />WHEREAS, thc Engineering Technician and Public Works Foreman for thc City of <br />Mounds View have rcviewed the proposed minor subdivision :md have found it acceptable: and, <br /> <br />WHEREAS, the Planning Commission reviewed this request on November 7, <br />2001. and recommended approval of the minor subdivision: and, <br /> <br />WHEREAS, in accordance with Section 1204.04, Subd. 4, a park dedication fee in the <br />amount of $2,346 is applicable with this proposed minor subdivision; and, <br /> <br />NOW, THEREFORE, BE IT RESOLVED, having found that the proposed subdivision <br />satisties City subdivision and zoning requirements and is in conformance with the <br />Comprehensive Plan, thc Mounds View City Council approves the minor subdivision of 7841 <br />Spring Lake Road requcsted by Brian Diehl, subject to thc following: <br /> <br />1. Prior to thc City affixing its signatures to the Resolution of approvaL the applicant <br />shall submit the required park dedication fee in the amount of $2,346. <br /> <br />2. The applicant shall be responsible for relocating the restricted access gates on <br />unimproved Knollwood Drive north an appropriate distancc to allow sul1icient <br />setback from the proposed driveway. <br /> <br />3. If the cul-de-sac is rcquired to be improved as a result of any future subdivision, thc <br />applicant shall be responsible for a proportionate share of the construction costs. <br /> <br />4. The applicant shall record the City Council resolution of approvaL the Ccrtiticate of <br />Survey, the parcel .'^" easement document, the parcel "B" eascment document. and <br />the right-of-way dedication document with Ramsey County within sixty (60) days of <br />final adoption, and present proof of such recording to the City of Mounds View. <br />failure to record these documents or provide proof of such recordation shall cause <br />this approval to be null and void. <br />
