<br />. <br /> <br />. <br /> <br />. <br /> <br />Resolution 5847 <br />September 23. 2002 <br />Page 2 <br /> <br />WHEREAS, the proposed development satisfies the dimensional requirements <br />of the Zoning Code; and, <br /> <br />WHEREAS, the site plans indicate that the proposed commercial building will be <br />21,809 square feet; and, <br /> <br />WHEREAS, proof of parking (up to 15% of the total parking requirement) is <br />allowed when it is determined that the parking requirement is greater than needed. <br /> <br />NOW THEREFORE BE IT RESOLVED that the Mounds View City Council, <br />finding that all of the requirements have been met, does hereby approve the <br />development review request and conditional use permit request for the construction of a <br />21,809 square foot commercial building utilizing joint facilities parking at 2214 County <br />Highway 10, subject to the following stipulations: <br /> <br />1. All utilities to the building shall be installed underground <br /> <br />2. The ground sign shall be of a monument style w;th a masonry base. No pole or <br />pylon signs shall be permitted. The sign shall be setback 15 feet from the <br />property line. <br /> <br />3. The garbage enclosure shall conform to City design standards. <br /> <br />4. The garbage enclosure shall be relocated if the proof of parking spaces located <br />near the west property line are improved. The new location shall be approved by <br />the Community Development Director. <br /> <br />5. The parking spaces designated as proof of parking shall be improved if the need <br />for additional parking arises, as determined by the Community Development <br />Director. <br /> <br />6. The applicants shall enter into a legal agreement with the neighboring property <br />Owner that grants permission for joint facilities parking and record such <br />document with Ramsey County. <br /> <br />7. The applicant shall arrange to record this resolution with Ramsey County. <br /> <br />8. The applicant shall enter into a development agreement with the City. <br />
