. . . RESOLUTION NO. 5851 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING A DEVELOPMENT AGREEMENT WITH MOUNDSVIEW JAKE'S, INC. DOING BUSINESS AT 2400 COUNTY HIGHWAY 10 WHEREAS, the City Council approved Resolution 5825 on August 26,2002, approving a Development Review for Jake's Sport's Cafe to expand their operations at 2400 County Highway 10; and, WHEREAS, the development property is zoned B-3, Highway Business, and is legally described as follows: fhat part (d'the S1',; 1 4 of the NW 1 4 of Section 8, township 30, Range 23, lying Southwesterly (?f" County State Aid Highway 10, Ramsey (',ounty. together l-t'ith an Access F-'asement setforth in all Acce.~:~'l'.,"asemeJ1t Agreement dated September 3, 1998, ((ndfi/ed April 12, 1999 as Document No. 3135379 in Ramsey County, Minnesota. and Lot 2, Block 1, Anthony Properties Addition, Ramsey COllnty, Minnesota. hereinafter referred to as the "Property;" and, WHEREAS, Resolution 5825 stipulates that Rob Jacob and Tony Jacob (owners and operators of the Jake's Sport's Cafe, the "Developer") enter into a Development Agreement with the City to ensure the orderly development of the Property; WHEREAS, the approved development will not involve the construction of any public utilities or public improvements; and, WHEREAS, the Development Agreement, attached as Exhibit A, in addition to ensuring for the orderly development of the Property, requires that the Developer consent to a trail way easement across the southerly ten feet of the property; and, WHEREAS, the Development Agreement also requires that the Developer reimburse the City for all third-party expenses incurred by the City in the processing of the Development Review and Development Agreement. NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council approves the attached Development Agreement and authorizes the Mayor and the City Administrator to sign the Agreement on the City's behalf.
