<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION NO. 5858 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT TO ALLOW AN AUTO <br />REPAIR FACILITY TO LOCATE IN A B-3, HIGHWAY BUSINESS DISTRICT, AT 2135 <br />PROGRAM A VENUE; MOUNDS VIEW PLANNING CASE NO. CU02-001 <br /> <br />WHEREAS, The applicant, Jason Studer, has applied for a conditional use permit to locate <br />an auto repair facility in a B-3, Highway Business Zoning District, specifically on the property <br />located at 2135 Program Avenue, which is legally described as follows: <br /> <br />Programmed Land First Addition <br />Block 2, Lot 2 <br />Ramsey COU/l(v, Minnesota <br /> <br />WHEREAS, The Mounds View Zoning Code conditionally allows auto repair in B-3 <br />zoning districts; and, <br /> <br />WHEREAS, the City Council has reviewed the following documents regarding this <br />proposal: <br /> <br />a. <br />b. <br /> <br />Planning Application <br />Location Map <br />Proposed Site Plan <br />Letter from Surrounding Property Owner <br />Applicant's Resume <br />Staff Report <br />Planning Commission Resolution 710-02 <br /> <br />c. <br />d. <br />e. <br />f. <br />g. <br /> <br />WHEREAS, the Mounds View City Council finds that the proposal satisfies the conditions <br />outlined in Chapter 1125 of the Zoning Code; and, <br /> <br />WHEREAS, the Mounds View City Council finds that the request is consistent with the <br />Mounds View Comprehensive Plan in that the Comprehensive Plan designates the subject property as <br />Community Commercial on the Future Land Use Map; and, <br /> <br />WHEREAS, the Mounds View City Council finds that the proposed auto repair facility would <br />not be out of place given the character and geography of the surrounding area; and, <br /> <br />WHEREAS, the Mounds View City Council finds that the proposed auto repair facility would <br />not depreciate the neighborhood; and, <br /> <br />WHEREAS, the Mounds View Planning Commission granted a variance from the minimum <br />lot area requirement on September 18, 2002; and, <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council approves <br />the conditional use pernlit with the following stipulations: <br />
