<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION NO. 5863 <br /> <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION APPROVING A DEVELOPMENT AGREEMENT WITH <br />MOUNDSVIEW BUSINESS PROPERTIES, LLC, FOR A COMMERCIAL <br />DEVELOPMENT AT 2214 COUNTY HIGHWAY 10 <br /> <br />WHEREAS, the City Council approved Resolution 5847 on September 23,2002, <br />approving a Development Review for Moundsview Business Properties, LLC, for a <br />proposed commercial development located at 2214 County Highway 10; and, <br /> <br />WHEREAS, the development property is zoned B-3, Highway Business, and is <br />legally described as follows: <br /> <br />Herbst Enterprises <br />Lot 1, Block 1 <br />Ramsey County, Minnesota <br /> <br />hereinafter referred to as the "Property;" and, <br /> <br />WHEREAS, Resolution 5847 stipulates that Moundsview Business Properties, <br />LLC enter into a Development Agreement with the City to ensure the orderly <br />development of the Property; <br /> <br />WHEREAS, the approved development will not involve the construction of any <br />public utilities or public improvements; and, <br /> <br />WHEREAS, the Development Agreement, attached as Exhibit A, in addition to <br />ensuring for the orderly development of the Property, requires that the Developer <br />consent to a trailway easement across the southerly ten feet of the property; and, <br /> <br />WHEREAS, the Development Agreement also requires that the Developer <br />reimburse the City for all third-party expenses incurred by the City in the processing of <br />the Development Review and Development Agreement. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council <br />approves the attached Development Agreement and authorizes the Mayor and the City <br />Administrator to sign the Agreement on the City's behalf. <br />
