RESOLUTION NO. 3022 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION DENYING VARIANCE REQUEST BY PHILLIPS 66 FOR CURB CUT LOCATION SETBACK, 2525 HIGHWAY 10, PLANNING CASE NO. 288-90 WHEREAS, Phillips 66 Company has been denied the variance request from the Planning Commission; and WHEREAS, the applicant has the right to appeal to the City Council if the Planning Commission does not act in favor of the applicant; and WHEREAS, the City Council has reviewed the request by Phillips 66 Company for a variance from the curb cut location setback requirements; and WHEREAS, the City Council has reviewed and taken into consideration the applicant's hardship statement as required for a variance request; and WHEREAS, the City Council has reviewed the zoning ordinance section requiring fifty (50) feet from the intersec- tion of lot lines; and WHEREAS, the City Council has reviewed the City Engineer'S recommendation to relocate the Long Lake Road access to Bronson Drive; and WHEREAS, the City Council has reviewed and taken into consideration the City Attorney's opinion of the hardship statement presented by the applicant as outlined in the Planning Commission minutes of March 7, 1990; and WHEREAS, the City Council has reviewed the criteria for granting a variance per Section 40.26; and WHEREAS, the City Council has considered alternatives to the proposed site plan; and WHEREAS, the City Council determines that there are not reasonable alternatives to the proposed site plan. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Mounds View denies the variance request.
