RESOLUTION 6929 <br />• CITY OF MOUl~TDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION AFFIRMING CHARGES ASSOCLATED WITH <br />ABATE117ENT OF VIOLATIONS AT 5300-02 RAYMOND AVENUE MOUNDS VIEW, <br />1INNESOTA, 5512.2. <br />WHEREAS, on June 16, 2006, staff inspected the property located at 5300-02 Raymond <br />Avenue in response to a complaint regarding a large accumulation of garbage on the exterior of <br />the property <br />WHEREAS, on June 16, 2006 staff observed a large accumulation of household garbage, <br />rotting food, and other debris on the exterior or the property near the curbside. <br />WHEREAS, the accumulation of household garbage, rotting food, and other debris <br />constituted an immediate threat to the public health and safety. <br />WHEREAS, Mounds View code of ordinances Section 607.09 Subdivision 6 authorizes <br />for abating a public nuisance when there is an immediate threat to the public health or safety; and <br />WHEREAS, staff ordered an summary abatement at 5300-02 Raymond Avenue on June <br />• 16, 2006 and city staff removed said accumulations of household garbage, rotting food, and other <br />debris from the exterior of the premises and disposed of in an approved manner; and <br />WHEREAS, the City Council finds that the accumulation of 5300-02 Raymond Avenue <br />on June 16, 2006 constituted an immediate threat to the public health or safety; and <br />WHEREAS, on June 30, 2006 staff mailed a notice to the taxpayer of 5300-02 Raymond <br />Avenue with an invoice due payable within 30 days for the cost of said abatement. <br />WHEREAS, staff received a letter from the taxpayer of record, Mr. Anthony Osuji, indicating a <br />desire to appeal the charges of the summary abatement; and <br />WHEREAS, in a letter to Mr. Anthony Osuji and the new taxpayer of record, Irene <br />Wisseh, dated August 4, 2006, staff notified both parties of their opportunity to be heard before <br />the council on. August 28, 2006; and <br />WHEREAS, the City has complied with the notification requirement for abatement as <br />stated in Section 607.09, Subdivision 6d. of the Mounds View Municipal Code; and <br />• <br />
