• RESOLUTION 7000 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />APPROVING AN AGREEMENT FOR MAINTENANCE AND EVP SYSTEM <br />AGREEMENT FOR THE TRAFFIC CONTROL SIGNALS AT COUNTY ROAD J <br />AND XYLITE STREET, AND COUNTY ROAD J AND CORAL SEA STREET <br />WHEREAS, as part of the County Road J Improvement Project, <br />two new traffic control signals will be added at the intersections of County Road J <br />and Xylite Street, and County Road J and Coral Sea Street; and <br />WHEREAS, with the installation of these signals, there will need to <br />be an agreement with Ramsey County, Anoka County, the City of Blaine, and the <br />City of Mounds View pertaining to the maintenance of these new signals; and <br />WHEREAS, Ramsey County has submitted two separate <br />agreements; Agreement No. PW2005-19 for the signal system located at County <br />Road J and Xylite Street, and Agreement No. PW2005-20 for the signal system <br />located at County Road J and Coral Sea Street; and <br />• WHEREAS, the language and assigned responsibilities contained. <br />within these agreement documents are consistent with other signal agreement <br />the City has executed with Ramsey County; and <br />WHEREAS, the City of Blaine and the City of Mounds View will <br />equally share costs and maintenance responsibilities that are typically assigned <br />to the City in which the signal is located; and <br />WHEREAS, the City's legal counsel has reviewed these draft <br />agreements and found them to be fairly straight forward regarding the provisions <br />relating to who is responsible #or the maintenance and cost of the light and EVP <br />system; and <br />WHEREAS, the City's legal counsel did have some issues and <br />questions pertaining the indemnification wording in the agreement. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the <br />City of Mounds View, Ramsey County, Minnesota as follows: <br />1. Traffic Control Signal Maintenance Agreement and EVP System <br />Agreement No. PW2005-19 and Agreement No. PW2005-20 with <br />Ramsey County, Anoka County, and the City of Blaine are hereby <br />approved pending approval by the City's legal counsel. <br />• <br />
