RESOLUTION N0.6733 <br />• CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF NIINNESOTA <br />ORDERING THE ABATEMENT OF NUISANCE CONDITIONS EXISTING AT <br />2408-10 COUNTY RD I, OPERATED AS SAMS FOOD MARKET AND SELF SERVE <br />LAUNDRY, IN THE CITY OF MOUNDS VIEW <br />WHEREAS, the Housing Inspector of the City of Mounds View has determined that <br />conditions present at 2408-10 County Rd I in the City of Mounds View constitute a nuisance <br />within the meaning of Minnesota Statutes, Section 561.01, 561.02, and Mounds View City Code <br />Chapter 607. <br />WHEREAS, based on the investigation of the Housing Inspector it is recommended that <br />conditions described in a notice of violation dated December 28, 2005 are abated; and <br />WHEREAS, in a letter to the responsible parties dated January 31, 2006 staff notified the <br />responsible parties of its intent to appear before the Mounds View City Council to request <br />authorization to abate nuisance conditions at 2408-10 County Road I; and <br />WHEREAS, Minnesota Statutes, Section 561.03 and Mounds View City Code, Section <br />• 607.09 Subdivision 5 authorize the City of Mounds View to correct said violations by abatement at <br />the expense of the property owner, occupant, or other responsible party. <br />WHEREAS, the City has complied with the notification requirement for nuisance <br />abatement in Section 607.09, Subdivision Sb of the Mounds View Municipal Code; and <br />WHEREAS, Sadiq Punjani, the listed taxpayer of 2408-10 County Rd I, will be liable to <br />the City for the costs of such abatement, including administrative costs pursuant to Section <br />607.09, Subdivision 7 of the Mounds View Municipal Code; and <br />NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds View as <br />follows: <br />1. The City of Mounds View finds that conditions existing at 2408-10 County Rd I, <br />know and operated as Sam's Food Market and a Self Serve Laundry, constitute a nuisance within the <br />meaning of Minnesota Statutes, Section 561.01, 561.02 and Mounds View City Code Chapter 607. <br />2. Graffiti shall be abated in the most practical manner <br />3. The City Attorney is authorized to take all necessary legal steps to abate said <br />conditions. <br />• 4. Any unpaid portion of the abatement costs after 30 days of the date on the invoice <br />may be certified as special assessments against the property pursuant to Minnesota Statutes, <br />Section 429.101 and Section 607.09, Subd. 7 of the Mounds View Municipal Code. <br />
