• RESOLUTION 6767 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />APPROVING THE PRELIMINARY FEASIBILITY REPORT, WAIVING PUBLIC <br />IMPROVEMENT HEARING, ORDERING THE PROJECT, AND AUTHORIZING <br />THE PREPARATION OF PLANS AND SPECIFICATIONS FOR THE <br />MEDTRONIC UTILITY EXTENSION PROJECT <br />WHEREAS, on October 10, 2005, the City Council approved Resolution <br />6652 authorizing the preparation of a preliminary feasibility report and consultant <br />selection for the extension of public utilities to the Medtronic CRM Development <br />Project; and <br />WHEREAS, a preliminary report has been prepared and, based upon this <br />analysis, the project is felt to be necessary, cost effective and feasible; and <br />WHEREAS, on March 6, 2006 a draft preliminary feasibility report was <br />submitted at a Work Session for the City Council's review; and <br />WHEREAS, the purpose of the public improvement hearing is to provide <br />• interested parties an opportunity to learn more about the proposed improvements <br />and to comment on them; and <br />WHEREAS, As per the developer's agreement with Medtronic, paragraph <br />(b) of section 4.6 states: <br />(b) Public Improvements. The City agrees to construct the Public <br />Improvements at its expense. The City is required to install necessary offsite <br />water and sewer line improvements necessary for the Development Property. <br />This includes extension of the water main, sanitary sewer and storm sewer lines <br />to the Development Property; and <br />WHEREAS, the City has been petitioned for these improvements via <br />developer's agreement with Medtronic and according to State Statute, a Public <br />Improvement Hearing is not required; and <br />WHEREAS, waiving the official hearing does not precluded the City from <br />conducting a hearing or allowing public input; and <br />WHEREAS, should the Council wish to proceed with this project, the next <br />step in the public improvement process is to order the project; and <br />WHEREAS, should the Council wish to proceed, the next step in the <br />• engineering process is to order the preparation of plans and specifications; and <br />
