Mounds View City Council July 14, 2014 <br />Regular Meeting Page 5 <br /> <br />Council Member Mueller questioned how existing buildings would be impacted by the proposed <br />overlay district. Planning Associate Heller stated future expansions of existing structures could <br />match existing structures. However, all new buildings would have to comply with the overlay <br />district. <br /> <br />Mayor Flaherty asked for the boundaries of the overlay district. Planning Associate Heller <br />reported the boundaries would span along the County Highway 10 corridor from County Road H <br />to Pleasantview. <br /> <br />Mayor Flaherty inquired how much latitude staff would have in approving complementary <br />building materials. Planning Associate Heller reported all final decisions would remain with the <br />City Council. City Administrator Ericson discussed this matter in further detail and stated new <br />building materials, processes and techniques that meet the intent and purpose of the code could <br />be granted by staff. <br /> <br />MOTION/SECOND: Mueller/Meehlhause. To Waive the First Reading and Introduce <br />Ordinance 888, Amending Title 1100 by adding Chapter 1128, County Road 10 Overlay District. <br /> <br /> Ayes – 5 Nays – 0 Motion carried. <br /> <br />D. First Reading and Introduction of Ordinance 889, Revising Chapter 512 of <br />the Mounds View City Code Pertaining to Cigarette and Tobacco Products. <br /> <br />Assistant City Administrator Crane stated that on April 14th the Council approved a Resolution <br />that approved a Tobacco license for Sam’s Market contingent upon several conditions. She read <br />these conditions in full for the record. Staff had concern with the sale of single cigars, known as <br />blunts, at Sam’s Market. For this reason, the Ramsey County Tobacco Coalition and City <br />Attorney recommended City Code pertaining to cigarette and tobacco products be amended. She <br />reported the proposed amendment would eliminate the possible sale of single cigars to minors. <br />Staff reviewed the proposed language within Chapter 512 of City Code and recommended the <br />Council introduce the Ordinance. <br /> <br />Council Member Gunn opposed Item D within the Ordinance. Assistant City Administrator <br />Crane reported this Item has been reworded to read, the licensee must post a sign at the front <br />entrance that prohibits the selling of tobacco and tobacco related products to minors. <br /> <br />Council Member Gunn asked if the City could regulate pricing or if this was mandated by the <br />State. She did not believe that the City wanted to be in the business of regulating tobacco <br />product prices. Assistant City Administrator Crane reported cigars were regulated differently <br />than cigarettes. <br /> <br />Council Member Hull did not agree with the City becoming the pricing agent for cigars. He <br />questioned how the City would gauge moral character. City Administrator Ericson discussed <br />how this issue would be determined by the City and its attorney through the application process. <br />
