Planning Associate Heller reported only the applicant spoke regarding <br />this case. <br /> <br />Mayor Flaherty believed that the public support would have been helpful at the Planning <br />Commission meeting. He feared that this case could set precedence if the denial were <br />overturned. He expressed concern about the order in which the applicant pursued the garage <br />building permit and variance. <br /> <br />Mr. Jensen stated he had the understanding that the variance request would be approved given <br />the location of his home. He explained he would not have built the garage had he known the <br />curb cut would not be approved. <br /> <br />Mayor Flaherty discussed the reasons the City Council had moved away from allowing second <br />curb cuts. <br /> <br />MOTION/SECOND: Mueller/Hull. To Waive the Reading and Adopt Resolution 8284, Over <br />Turning the Planning Commission’s Denial of a Variance for a Second Curb Cut at 7800 <br />Groveland Road. <br /> <br />Council Member Hull supported the second curb cut due to the fact Mr. Jensen did not live on a <br />busy street. In addition, he did not want the property value to be harmed given the fact there was <br />a garage in the rear yard without a driveway. He appreciated the work conducted on this case <br />conducted by staff and the Planning Commission. <br /> <br />Council Member Mueller appreciated the work of the Planning Commission as well and <br />understood that Mr. Jensen did not approach this matter in the correct order. However, she <br />supported the second curb cut given the fact it would reduce the wear and tear on the City curb <br />and would improve the traffic flow in the neighborhood. <br /> <br />Council Member Gunn agreed. She reiterated the fact that Mr. Jensen would be responsible for <br />installing a hard surface driveway and curb cut within one year. She commented that this would <br />be at Mr. Jensen’s expense and would have to be approved by the City. Mr. Jensen understood <br />these requirements. <br /> <br />Council Member Meehlhause stated he would not be supporting this request. He believed that <br />the variance request should have been made prior to the construction of the garage. He did not <br />want to see the Council setting a precedence by approving this variance request. <br /> <br />Mayor Flaherty reported Mr. Jensen created a precarious situation for the City Council. He <br />appreciated the support provided by his neighbors and noted he was in favor of the second curb <br />cut. <br /> <br /> Ayes – 4 Nays – 1 (Meehlhause) Motion carried.
