1 <br />of Mounds View Staff <br />Item No: 07C <br />Meeting Date: Aug 26, 2013 <br />Type of Business: Council Business <br />To: Honorable Mayor and City Council <br />From: James Ericson, City Administrator <br />Item Title/Subject: Second Reading and Adoption of Ordinance 880, an <br />Ordinance Amending Title 500 to Include Licensing <br />Requirements for Donation Collection Bins <br />Introduction: <br />In 2007 and 2009, the City had been asked to consider allowing donation collection bins in <br />the community. Both times the City Council was disinclined to allow the donation bins due <br />to repeated problems with ones that had been located in the community without <br />permission. The bins were unsightly and often had donations and other accumulated junk <br />alongside them for extended periods of time. For reasons such as these, the bins were <br />considered a nuisance and in violation of the City Code. <br />Discussion: <br />US'Again, a for-profit textile and small goods recycler, has requested that the Council <br />reconsider its position on donation collection bins and provided sample licensing <br />restrictions than could be adopted to ensure proper maintenance and operation of such <br />bins. At the June 3, 2013, Work Session, the Council directed staff to draft suitable <br />language for its consideration. Ordinance 880 provides for operational restrictions that <br />would be added to Title 500 (Business License Regulations) of the City Code. If <br />approved, bins would be permitted on properties owned and operated as an educational, <br />religious, non-commercial charitable use. Items left outside the bin would be removed within <br />24 hour's notice or be subject to penalties, including license revocation. An exemption is <br />provided for bins associated with religious and educational fund-raising activities. <br />The first reading of proposed ordinance 880 was held on July 22, 2013. The only changes <br />between the first and second reading is the elimination of a definition for "temporary" and a <br />more comprehensive exemption for religious and educational fund-raising activities. <br />Recommendation: <br />Hold the second reading and adopt Ordinance 880, an Ordinance creating a new Chapter <br />519 outlining the licensing standards associated with Donation Collection Bins in the City. <br />If approved, the ordinance would be effective October 5, 2013. <br />Respectfully submitted, <br />James Ericson <br />City Administrator <br />
