T Meeting Date: Feb 12018 <br />��/ Type of Business: Council Business <br />ilhAdministrator Review: L.c <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Jon Sevald, City Planner/Supervisor <br />Item Title/Subject: First Reading and Introduction of Ordinance 939, Amending <br />Municipal Code, Section 702.01, Subd 13(b), regarding <br />Possession, Aiming or Discharging of Weapons (Special Planning <br />Case SP-211-18) <br />Introduction: <br />INH Properties, developer of Crossroad Pointe, is proposing a mixed-use development, <br />including an indoor shooting range (Heartland Gun Club & Range). <br />The current Municipal Code prohibits the possession (with exceptions) and discharge of <br />weapons within city limits. The proposed amendment clarifies this prohibition to "public places", <br />which excludes "a person's residence; a person's place of business if owned or managed by the <br />person; a permitted gun show; a place of business permitted for the buying or selling of <br />weapons; or a facility permitted for hunting or target practice". <br />Discussion: <br />INH Property's lender has expressed concerns about the current ordinance prohibiting the <br />discharge of firearms within city limits. This amendment is necessary for INH to proceed with <br />site planning expenses. Approval of this amendment is not approval of the proposed indoor <br />shooting range. That would occur as part of the PUD process. <br />Specific to Crossroads Pointe, INH Properties will be applying for: <br />1. Rezoning' from B-3 to PUD (public hearing) <br />2. Major Subdivision (public hearing) <br />3. Vacation of portion of Greenfield Ave (public hearing) <br />4. Development Review <br />The proposed amendment is city-wide, and not specific to Crossroad Pointe. Staff interprets an <br />indoor shooting range as a "Commercial Recreational Use", which is a permitted use within the <br />B-3 Highway Business, and B-4 Regional Business districts. It is Staff's understanding that <br />Simons Sporting Goods (B-2 District) had sold firearms for decades, without incident. <br />Staff has occasionally, (but rarely) received inquiries of if shooting BB guns or bow hunting is <br />allowed in Mounds View. It is not, and will continue to be prohibited, except within facilities <br />permitted by the City, and compliant with state and federal regulations. <br />Recommendation: <br />Staff recommends that the City Council conduct a First Reading and Introduction of Ordinance <br />939, amending Municipal Code, Section 702.01, Subd 13(b), relating to the discharge of <br />weapons within the city. <br />Municipal Code, Section 1120.04, Subd 2(b)(2) (Process). Note: PUD's may be applied through a Rezoning or a Conditional <br />Use Permit (case by case basis). In this example (Crossroad Pointe), the PUD would be applied as a Rezoning from B-3 <br />Highway Business to PUD (Mixed -Use PUD). If the property had already been zoned PUD, and a different use were <br />proposed, then a CUP would be appropriate. <br />
