Discuss Possible Code Amendments in Chapter 1010, Wetlands <br />Planning Associate Heller discussed the Wetland Chapter of the City Code. She proposed a <br />portion of Subdivision 4 be reworded to allow for a non -conforming property to be built on <br />without requiring a variance. She requested comment from the Commission on the proposed <br />code amendment. <br />Commissioner Carvelli-Yu requested further clarification. <br />Associate Heller discussed the proposed language change in further detail. She explained that <br />the wetlands would still be protected through another portion of City Code. <br />Commissioner Elofson asked if the wetlands were regulated by the City. <br />Associate Heller explained that the Rice Creek Watershed governed wetlands that were an acre <br />or larger. The City had governance over smaller wetlands. She then discussed the wetland <br />buffer zone that was regulated by the City. <br />Chair Stevenson requested staff read Subdivision 4 for the Commission and asked where staff <br />was proposing changes. <br />Associate Heller read the language in full and proposed amending the language in Letter A. <br />The Commission recommended staff proceed with the proposed code amendment. <br />B. Review Commissioner Applications for 1 Expiring Seat <br />Planning Associate Heller informed the Commission that Commissioner Gary Rundle's term was <br />expiring on December 31, 2013. The City advertised the open seat and the City received two <br />applications, one from Gary Rundle and the other from Jessica Birken. Staff had invited Ms. <br />Birken to attend this evening's meeting. <br />
