MV Item No: <br />`/1L.yV Meeting Date: September 17, 201414 <br />Type of Business: Planning Case <br />City of Mounds View Staff Report <br />To: Mounds View Planning Commission <br />From: Heidi Heller, Planning Associate <br />Item Title/Subject: Consideration of a Conditional Use Permit for a 150 <br />foot Cell Tower at 4860 Mustang Circle, Dell -Comm; <br />Planning Case CU2014-001 <br />Introduction: <br />The applicant and property owner, FAC Holdings (Dell -Comm is the business operating <br />here), is requesting approval of a conditional use permit to construct a 150 foot cell tower on <br />their property at 4860 Mustang Circle. Dell -Comm designs, furnishes and installs <br />telecommunications systems, applications and services. They have been in business since <br />1990 and do infrastructure cabling, fiber optic cabling, outside plant cabling, security <br />solutions and telephone systems. <br />City Code Requirements: <br />Section 1124.03, Subd. 2: Allows for towers and antennae as a conditional use in specific <br />districts. Industrial districts allow towers and antennae up to 150 feet tall. <br />Section 1124.05 Subd. 1 Setbacks: The minimum setback from any property line or public <br />right-of-way for a wireless telecommunications tower is thirty feet (30') unless abutting a <br />residential district, then at least half the height of the tower. When placed on a lot improved <br />with a principal building, the wireless telecommunications tower shall be located only in the <br />rear yard or interior side yards not abutting streets. Wireless telecommunication towers shall <br />not be placed between the principal building and any street abutting the property. Setbacks <br />for accessory equipment structures associated with wireless telecommunication towers and <br />antennae shall meet the requirements as outlined in Section 1104.01, subdivision 4 of the <br />Zoning Code. <br />Section 1125.01, Subd. 1e: The Planning Commission is required to review the possible <br />adverse effects of the requested conditional use. <br />Section 1125.01, Subd. 1-q: which states that the Planning Commission shall make findings <br />of fact and recommend such actions or conditions relating to the request as it deems <br />necessary to carry out the intent and purpose of the Zoning Code and forward such findings <br />to the City Council. <br />Discussion: <br />Dell -Comm is proposing to construct a 150 -foot tall cell tower on their property. <br />Telecommunication towers are allowed in all zoning districts, but the heights permitted vary <br />by the property zoning. Industrial districts allow for the tallest towers at 150 feet. The <br />proposed tower would be located on the southeast corner of their property in a wooded, <br />unused area. Dell -Comm would own the tower and use it for empoyee training and <br />certification purposes, along with leasing antenna space to other cellular phone companies. <br />
