SECTION 6. That proper notice of a public hearing has been given and public <br />hearings have been held before the Planning Commission and City Council on this <br />issue. <br />SECTION 7. That the City Council has determined that this Zoning Code <br />Amendment clarifies a prior interpretation of the Zoning Code and is exempt from the <br />California Environmental Quality Act ("CEQA") In conformance with Tale 14 California <br />Code of Regulations section 15061(b)(3) "General Rule" and finds that no significant <br />environmental impactwill result from approving this code amendment. <br />SECTION B. That upon consideration of the staff report; Planning Commission <br />recommendation; Factors to be Considered, attached as Exhibit "A" to this Ordinance <br />and incorporated by this reference; and- all public testimony presented at the hearing <br />held on this project, this City Council finds the Zoning Code Amendment to be <br />consistent with the General Plan and all applicable specific plans of the City of <br />Escondido. <br />SECTION 9. That Article 36 of the Zoning Code is replaced with the following: <br />Article 36. CARGO CONTAINER RESTRICTIONS <br />Sec. 33-720. Definition and Purpose. <br />(a) Definition. A Cargo Container is an industrial, standardized reusable metal <br />vessel that was originally, specifically, or formerly designed for or used in the <br />packing, shipping, movement or transportation of freight, articles, goods or <br />commodities .by commercial trucks, trains and/or ships. A cargo container <br />modified in a manner that would preclude future use by a commercial <br />transportation entity shall be considered a cargo container for purpose of this <br />article, <br />
