SECTION 1. SHORT TITLE AND DEFINITIONS <br />1. Short Title. This Franchise Ordinance shall be known and cited as the Comcast <br />Cable Franchise Ordinance. <br />2. Definitions. For the purposes of this Franchise, the following terms, phrases, <br />words, and their derivations shall have the meaning given herein. When not inconsistent with the <br />context, words in the singular number include the plural number. The word "shall' is always <br />mandatory and not merely directory. The word "may" is directory and discretionary and not <br />mandatory. <br />a. 'Basic Cable Service" shall be defined as set forth in applicable law, which <br />is currently defined in 47 USC § 522(3) as any service tier which includes the <br />retransmission of local television broadcast signals. <br />b. "City" means City of Mounds View, a municipal corporation, in the State <br />of Minnesota, acting by and through its City Council, or its lawfully appointed designee. <br />C. "City Council" means the governing body of the City. <br />d. "Cable Service" or "Service" shall be defined as set forth in applicable law, <br />which is currently defined in 47 USC § 522(6) as the one-way transmission to subscribers <br />of (i) video programming, or (ii) other programming service, and subscriber interaction, if <br />any, which is required for the selection or use of such video programming or other <br />programming service. <br />e. "Cable System" or "System" shall be defined as set forth in applicable law, <br />which is currently defined in 47 USC § 522(7) as a facility, consisting of a set of closed <br />transmission paths and associated signal generation, reception, and control equipment that <br />is designed to provide cable service which includes video programming and which is <br />provided to multiple subscribers within a community, but such term does not include (A) <br />a facility that serves only to retransmit the television signals of I or more television <br />broadcast stations; (B) a facility that serves subscribers without using any public right-of- <br />way; (C) a facility of a common carrier which is subject, in whole or in part, to the <br />provisions of subchapter II of the Communications Act of 1934, as amended, except that <br />such facility shall be considered a cable system (other than for purposes of section 541(e) <br />of the Federal Cable Act) to the extent such facility is used in the transmission of video <br />programming directly to subscribers, unless the extent of such use is solely to provide <br />interactive on -demand services; (D) an open video system that complies with section 573 <br />of the Federal Cable Act; or (E) any facilities of any electric utility used solely for operating <br />its electric utility system. This definition shall incorporate by reference the definition of <br />"cable communications system" in Minnesota Statutes Section 238.02, Subdivision 3, as <br />the same may be amended from time to time. <br />f. "Commission' means the North Suburban Communications Commission, a <br />municipal Joint Powers Commission. <br />2 <br />
