As an accessory to the <br />principal rental operation, the applicant requests that they be allowed to sell rental vehicles from <br />the site as well. The applicant indicates that the proposed hours of business would be from 7:00 <br />a.m. to 7:00 p.m. Monday through Friday, and 8:00 a.m. through 4:00 p.m. on Saturdays and <br />10:00 a.m. to 4:00 p.m. on Sundays. The applicants plan on repainting the building, expanding <br />the parking lot per the attached site plan and make landscaping improvements on the site. <br />The Planning Commission heard this request at their July 7 and July 21 meetings, and after some <br />discussion concerning the use and the potential impacts to the neighborhood, approved a <br />resolution recommending to the City Council that this CUP request be approved, with stipulations <br />that have been carried forward into the Council resolution. <br />Analysis: <br />Section 1114.04, Subd. 5 of the City Code requires that a conditional use permit be issued for <br />uses such as that proposed by the applicant. Specifically, it states that "Open or outdoor service, <br />sale and rental as a principal or accessory use and including sales in or from motorized vehicles, <br />trailers or wagons requires a Conditional Use Permit." The primary function of the proposed <br />business is the renting of automobiles, with an accessory use of sale of said rental vehicles. <br />Because of the restrictions placed upon auto sales operations, the extent of Thrifty's auto sales <br />may not exceed 30 percent of the gross floor area of the principal structure, which would translate <br />into no more than three vehicles. This location has a long history of automotive uses, and the <br />proposed use would not be inconsistent with the previous uses. The zoning of the property is <br />commercial although the comprehensive plan indicates a low density residential designation. <br />Because of the long-standing commercial history at this location and the impending revision to the <br />
