Item No. 16 6-1 <br />Staff Report No. <br />Meeting Date: <br />Type of Business: <br />WK Work Session; PH: Public Hearing; <br />CA: Consent Agenda; CB: Council Business <br />City of Mounds View Staff Report <br />To: Honorable Mayor & City Council <br />From: James Ericson, Planning Associate <br />Item Title/Subject: Public Hearing and consideration of Resolution 5351, a resolution <br />approving the issuance of a conditional use permit for an outdoor <br />produce sales stand at 2732 Highway 10, requested by Holiday <br />Stationstore <br />Date of Report: July 21, 1999 <br />Background: <br />Chuck Durand, representing the Holiday Stationstore, is requesting a conditional use permit to <br />operate an outdoor produce stand in the parking lot of the Holiday Stationstore, located at the <br />southeast corner of Highway 10 and Silver Lake Road from July through October of this year and <br />years thereafter. The produce is planned to be open from dawn to dusk, seven days a week. The <br />stand would be operated by Darcy Ewing of Big Lake, Minnesota. The sales tent is proposed to <br />be 12 feet square and would be located in the grassy area immediately adjacent to the bank of <br />parking stalls at the north corner of the lot. If there are no problems with the operation, the <br />applicant would like the opportunity to operate in subsequent years as was done with Linder's and <br />Merryville farm market. <br />Analysis: <br />This produce stand would be similar to the Merryville operation at Moundsview Square. Signage <br />for the produce stand will be accomplished with small banners affixed to the stand and covering. <br />As was done for the Linder's and Merryville, the conditional use permit for Holiday is drafted in <br />such a way so that future appearances before the Planning Commission and City Council are not <br />required. This allowance is conditioned on many factors, not the least of which is that there be no <br />problems associated with the operation this year. The CUP would then remain in effect indefinitely <br />so long as there are no changes to the operation and the applicant resubmit a letter of intent and site <br />plan each year in advance. <br />CUP Requirements: <br />The criteria for approval of a conditional use permit appear in Section 1114.04, Subd. 5 of the <br />Mounds View Municipal Code. They are as follows: <br />a. Outdoor service, sales and equipment rental connected with the principal use is <br />limited to thirty percent (30%) of the gross floor area of the principal use. <br />
