MOt1nmS Vi�V <br />City of Mounds View Staff R <br />Item No: 3 <br />Meeting Date: March 5, 2018 <br />Type of Business: WS <br />Administrator Review: _4, <br />To: Honorable Mayor and City Council <br />From: Jon Sevald, City Planner/Supervisor <br />Item Title/Subject: Discussion of Off -Sale Liquor Licensing <br />Introduction: <br />The City Council adopted a moratorium on the issuance of new Off -Sale Intoxicating Liquor <br />licenses on April 11, 2016 (Resolution 8551), expiring October 11, 2017. The moratorium was a <br />reaction to a proposed liquor store at Snap Market (currently vacant). The intent of the <br />moratorium was to investigate five questions relating to the negative effects of liquor stores. <br />During the January 2nd Council Work Session, the Council reviewed Staff's analysis of the five <br />questions. Staff's conclusion was that there is no direct correlation between liquor stores and <br />crime or decreased property values, but there are indirect correlations. <br />Staff continued this conversation with the Planning Commission at its January 31d and February <br />7th Commission meetings. <br />These discussions have not had a conclusion. Staff is requesting that the Council provide <br />direction whether to amend an ordinance, or leave as -is. <br />Discussion: <br />During the February 7th Planning Commission meeting, individual commission members made <br />the following recommendations: <br />1. Require a minimum 500' setback from parks, schools, churches, libraries, senior housing, <br />and commercial daycares. <br />2. Allow a maximum of four or five off -sale intoxicating liquor licenses, or limit the number <br />based on population. <br />3. The Council should consider what it is trying to accomplish, and if the proposed changes <br />does this. <br />Currently, liquor stores (Off -Sale Intoxicating Liquor License) are a permitted use in the B-2, B-3, <br />and B-4 districts. Liquor stores must be set back a minimum of 500' from a school or church <br />(property line to property line).' <br />Super America (B-3 district) currently holds a license for 3.2% Malt Liquor, and intends to <br />remodel its store to include Off -Sale Intoxicating Liquor (no ETA when they will apply for a <br />license). The store is located about 400' from Silver View Park (front door to park property), and <br />about 230' from Silver Lake Pointe (senior housing). <br />In Staff's opinion, the intent of the setbacks is; (1) establish a buffer between liquor stores and <br />non -compatible uses (schools and churches); and (2) deter persons from purchasing intoxicating <br />liquor and consuming it within a neighboring public place (e.g. park or parking lot).
