Item 08D <br />Ordinance 942 <br />Page 2 <br />of a gas station co -locating with a liquor store, such that a gate or other barrier could be closed <br />and locked at times when alcohol sales are prohibited. <br />This co -location is not permitted by State Statute, nor City Code. As discussed on March 12tH <br />customers would pass through the gas station to access the liquor store. Staff has discussed <br />this with the MN Dept. of Public Safety (alcohol retail license staff), who would interpret this <br />pass -though as not being an Exclusive Liquor Store. <br />An Exclusive Liquor Store could be located adjacent to a gas station (or other business), and <br />share a vestibule access but must maintain a separate second access. Examples can be found at <br />liquor stores adjacent to Cub Foods (Cub Wine & Spirits), and Kowalski's (The Wine Shop at <br />Kowalski's). <br />Four or Five Liquor Stores <br />Currently, there is no limit to the number of liquor stores within the City (First Class cities are <br />limited to one per 5,000 population 4). The proposed amendment limits this to four licenses for <br />liquor stores. <br />Recommendation <br />Staff recommends that the City Council conduct a First Reading and Introduction to Ordinance <br />942, amending Mounds View City Code, Section 502 related to On -Sale Intoxicating Liquor <br />Licenses. <br />During the City Council's March 12th discussion, the majority of the Council provided a <br />consensus to limit the number of liquor store licenses to four or five. The proposed <br />amendment is for four licenses.
