Item 08D Ordinance 942 Page 2 of a gas station co -locating with a liquor store, such that a gate or other barrier could be closed and locked at times when alcohol sales are prohibited. This co -location is not permitted by State Statute, nor City Code. As discussed on March 12tH customers would pass through the gas station to access the liquor store. Staff has discussed this with the MN Dept. of Public Safety (alcohol retail license staff), who would interpret this pass -though as not being an Exclusive Liquor Store. An Exclusive Liquor Store could be located adjacent to a gas station (or other business), and share a vestibule access but must maintain a separate second access. Examples can be found at liquor stores adjacent to Cub Foods (Cub Wine & Spirits), and Kowalski's (The Wine Shop at Kowalski's). Four or Five Liquor Stores Currently, there is no limit to the number of liquor stores within the City (First Class cities are limited to one per 5,000 population 4). The proposed amendment limits this to four licenses for liquor stores. Recommendation Staff recommends that the City Council conduct a First Reading and Introduction to Ordinance 942, amending Mounds View City Code, Section 502 related to On -Sale Intoxicating Liquor Licenses. During the City Council's March 12th discussion, the majority of the Council provided a consensus to limit the number of liquor store licenses to four or five. The proposed amendment is for four licenses. If the Council would like to change this, please provide direction to Staff. A Public Hearing Notice will be published in the March 30, 2018 edition of the New Brighton/Mounds View Sun Focus. A Public Hearing is scheduled for Monday, April 9, 2018 at 6:30 PM.
