<br />Item No: 7G <br />Meeting Date: January 3, 2017 <br />Type of Business: Council Business <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: James Ericson, City Administrator <br />Item Title/Subject: Resolution 8693, a Resolution Approving a Memorandum of <br />Understanding with LELS 204 Regarding Holiday Hours <br /> <br />Introduction: <br /> <br />Officer Sarah David was hired by the City of Mounds View on November 14, 2016, with a start <br />date of December 5, 2016. The labor agreement for the officers provides for holiday hours <br />totaling 104 hours per year. Because officers are schedule seven days a week, 24 hours a day, <br />officers are often scheduled to work on holidays. In the case of Officer David who is going <br />through her field training, she will accrue 24 hours of holiday time off with no ability to take the <br />time off. The labor agreement is silent on what to do in this scenario. <br /> <br />Discussion: <br /> <br />The police department asked the finance department how to deal with the situation of Officer <br />David being unable to utilize the holiday hours. Since there was no past practice to go on, the <br />City reached out to LELS in order to come to a mutual agreement on how to proceed. The <br />options considered included the following: <br /> <br />• The officer would forfeit the holiday hours <br />• The officer would be given time off during her field training <br />• The 24 hours of holiday time could carry over to 2017 <br />• The 24 hours of holiday time would be paid out after completing field training <br /> <br />Both the City and the Union would rather the officer not forfeit these holiday hours, and the City <br />would prefer the officer not be given the additional time off since continuity in the field training <br />process is critical, leaving two options. The City opposed allowing the carry-over of hours into <br />2017 leaving a payout of the time subsequent to successfully completing the field training as the <br />only remaining option that would be mutually agreeable to all parties. Should the officer not <br />complete the field training, the holiday hours earned in December as well as any accrued in the <br />early months of 2017 would be forfeited. <br /> <br />Recommendation: <br /> <br />The City Attorney drafted the attached Memorandum of Understanding (MOU) which has been <br />reviewed by LELS representatives and the employee. Staff recommends approval of Resolution <br />8693 which approves the attached MOU which is specific to the named employee and specific <br />to the present situation. This agreement would not constitute a past practice nor would it <br />obligate the City to pay out any future unused holiday time at year end or upon separation to the <br />named employee or any other employee. <br /> <br />Respectfully submitted, <br /> <br /> <br />________________________ <br />James Ericson <br />City Administrator
