Item No: 7A Meeting Date: February 8, 2016 Type of Business: Public Hearing City of Mounds View Staff Report To: Honorable Mayor and City Council From: James Ericson, City Administrator Item Title/Subject: Public Hearing – Consideration of Resolution 8506, a Resolution Reapproving a Conditional Use Permit for a 150 foot Cell Tower at 4860 Mustang Circle, Dell-Comm; Planning Case CU2014-001 Introduction: The applicant and property owner, FAC Holdings, operating in Mounds View as Dell-Comm, is requesting reapproval of a conditional use permit (CUP) to construct a 150 foot cell tower on their property at 4860 Mustang Circle. Dell-Comm designs, furnishes and installs telecommunications systems, applications and services. They have been in business since 1990 and do infrastructure cabling, fiber optic cabling, outside plant cabling, security solutions and telephone systems. The City Council approved the CUP in September of 2014 but due to issues with the FCC, the applicant was unable to proceed with the tower construction within the required timeframe resulting in a lapse of the CUP. The issues with the FCC have been addressed and the applicant is ready to move ahead with the construction. City Code Requirements: Section 1124.03, Subd. 2: Allows for towers and antennae as a conditional use in specific districts. Industrial districts allow towers and antennae up to 150 feet tall. Section 1124.05 Subd. 1 Setbacks: The minimum setback from any property line or public right-of-way for a wireless telecommunications tower is thirty feet (30’) unless abutting a residential district, then at least half the height of the tower. When placed on a lot improved with a principal building, the wireless telecommunications tower shall be located only in the rear yard or interior side yards not abutting streets. Wireless telecommunication towers shall not be placed between the principal building and any street abutting the property. Setbacks for accessory equipment structures associated with wireless telecommunication towers and antennae shall meet the requirements as outlined in Section 1104.01, subdivision 4 of the Zoning Code. Section 1125.01, Subd. 1e: The Planning Commission is required to review the possible adverse effects of the requested conditional use. Section 1125.01, Subd. 1g: which states that the Planning Commission shall make findings of fact and recommend such actions or conditions relating to the request as it deems necessary to carry out the intent and purpose of the Zoning Code and forward such findings to the City Council.
