<br />Item No: 07D <br />Meeting Date: May 9, 2016 <br />Type of Business: CB <br />Administrator Review: ____ <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Desaree Crane, Assistant City Administrator <br />Item Title/Subject: Public Hearing: Resolution 8574, a Resolution to Consider an <br />Off-Sale 3.2 Malt Liquor License Renewal for SuperAmerica, <br />located at 2640 County Road I <br /> <br /> <br />Introduction: <br /> <br />In accordance with Chapter 503 of the Mounds View City Code, a public hearing is required for all <br />3.2 Malt Liquor License renewals. The City of Mounds View issued an Off-sale 3.2 Malt Liquor <br />License for SuperAmerica effective July 1, 2015, and their renewal is before the Council for <br />consideration. SuperAmerica’s Off-Sale 3.5 Malt Liquor License will expire June 30, 2016. <br /> <br /> Discussion: <br /> <br />The notice of this public hearing was sent out to residences within a 350 feet radius, and the Notice <br />of Public Hearing was published in the City’s official newspaper. Property taxes on this property are <br />current. <br /> <br />SuperAmerica has submitted their city liquor license application materials and the applicable fees. <br />The following investigations and inspections have been conducted to determine whether there is <br />cause for the City to deny the above referenced intoxicating liquor license application: <br /> <br />Police Inquiry and Investigations (Mounds View Police Department) <br />Staff has submitted a criminal background check to the Minnesota Bureau of Criminal <br />Apprehension, and has not received the criminal background check. This liquor license renewal will <br />be contingent on a satisfactory background check. <br /> <br />The Mounds View Police Department will be conducting compliance checks before the expiration of <br />this license. Staff recommends this license contingent on a satisfactory report from the Mounds <br />View Police Department. <br /> <br />Utility Billing Inquiry (City of Mounds View) <br />The Finance Department has issued a satisfactory report for SuperAmerica. <br /> <br />Fire Inspection (City of Mounds View Fire Marshal) <br />The City’s Fire Marshal will be inspecting the building on Thursday, June 2, 2016. This license <br />renewal will be contingent on a satisfactory fire inspection. <br /> <br />Recommendation: <br /> <br />Staff recommends that the City Council open the Public Hearing for public input. Staff recommends <br />approval of this business license contingent on a satisfactory report from the Mounds View Police <br />Department, satisfactory criminal background check and a satisfactory fire inspection report.
