KF.2420 May 17, 1999 <br /> Version: Conference Committee Report Page 45 <br /> Section_ <br /> (HACA) payments to counties, an amount representing the net cost to the state for <br /> assumption of district court costs. The HACA subtraction is $3 million less in the first year <br /> than the cost of the state takeover to help provide counties with half of the funding for the 6- <br /> month transition problem(calendar/fiscal year). <br /> 4 Fines and forfeited bail. Provides that in counties where the state has full responsibility for <br /> court administration costs, fines and forfeited bail collected by the state patrol that would <br /> otherwise go to the county will be deposited in the general fund. <br /> 5 Screener-collector. Provides that in counties where the state has full responsibility for <br /> court administration costs, screener-collector fees shall be deposited in the general fund. <br /> 6 Family preservation aid. Reduces the increase in family preservation aid from$30 million <br /> to $20 million in calendar year 2000, as a result of the $10 million HACA transfer <br /> cancellation in section 2. <br /> 7 Court fees. Strikes reference to certain court administration and forfeited bail fees being <br /> deposited in the general fund. <br /> 8 Property tax levy. Prohibits the counties in the fifth, seventh, and ninth judicial districts <br /> from levying property taxes for the court functions that have been transferred to the state, <br /> except for the amount necessary to pay for one-half of the costs of the first six months of <br /> calendar year 2000. (Levy limits are adjusted for one year. See Article 6.) <br /> 9 County court; forfeitures. In law dealing with county courts, provides for sums forfeited <br /> to be paid to the general fund. <br /> 10 County court; fines and penalties. Provides that in counties where the state has full <br /> responsibility for court administration costs, fines and fees that currently go to counties, will <br /> instead go to the state and be credited to the general fund. <br /> 11 Bonds; fines and forfeitures. Provides that in counties where the state has full <br /> responsibility for court administration costs, bond fines and fees that currently go to <br /> counties, will instead go to the state and be credited to the general fund. <br /> 12 Appropriation. Appropriates $18,731,000 to the district courts for the state assumption of <br /> funding district courts under this article. (This includes both the HACA offset and the fees <br /> and fines.) <br /> 13 Effective dates. (a) Provides that sections 2 and 6 are effective for aid payable in 2000. . <br /> Other provisions are effective January 1,2000 with respect to counties in the 8th judicial <br /> district, and July 1, 2000 with respect to counties in the 5th, 7th, and 9th judicial districts. <br /> (b) Provides that this article does not take effect unless the state assumes the district court <br /> costs under S.F. 2221. <br /> • <br /> Article 11: State Funding of District Courts <br />
