reasonably practical to such areas designated and requested by the Municipality within the <br /> Territory. <br /> 3.2 All portions of the Territory shall be designated on a map which shall be supplied <br /> by the Municipality to the Fire Department. <br /> 3.3 Fire Department agrees to furnish the building inspection,plan review, and site <br /> review services and necessary personnel as reasonably requested by the Municipality to the said <br /> designated areas in the Territory, for the consideration set forth below, and agrees that its <br /> building inspection personnel will make every reasonable effort to respond to requests from the <br /> Municipality for inspection services. <br /> 3.4 Fire Department and Municipality each agrees to the position description and <br /> performance of the duties as described on APPENDIX A of this document, which is attached <br /> hereto and made a part hereof. <br /> 3.5 The Fire Department agrees to perform all duties as required by Minnesota <br /> Statutes. <br /> ARTICLE IV. COMPENSATION <br /> 4.1 Payment for the services provided by the Fire Department to the Municipality <br /> shall be as follows: <br /> (a) Subject to Subsection 4.1(c)below, the Municipality will pay the Fire Department <br /> fees for services rendered by the Fire Department under this Agreement(the "Service Fees") in <br /> accordance with Subsection 4.1(b) below. <br /> (b) Payment for services shall be made upon presentation of periodic billing <br /> statements to the Municipality. The Municipality shall make payment to the Fire Department <br /> within thirty (30) days of its receipt of the billing statement or make reasonable arrangements for <br /> payment acceptable to the Fire Department. <br /> (c) Except as otherwise adjusted upward from time to time in accordance with the <br /> Consumer Price Index(the "CPP"), the annual cost to the Municipality for the Service Fees shall <br /> not exceed Thirty-Five Thousand Dollars ($35,000) per year(a figure based on historical <br /> numbers of plan review and inspections)unless said activity increases by a margin of ten(10%) <br /> or more in any year, at which time the Fire Department and the Municipality shall in good faith <br /> renegotiate a compensation package. <br /> (d) In addition to the Service Fees and amounts negotiated, if any, in accordance with <br /> Subsection 4.1(c), the Municipality will pay the Fire Department a fee of Five Thousand Dollars <br /> ($5,000) (the"Administration Fee") on the date of this Agreement and,thereafter, on January 1 <br /> Mounds View Building Inspector Contract- <br />
