Mr. Tobias had <br /> been denied a variance to allow for two curb cuts at his property. <br /> Discussion: <br /> The discussion at previous Council meetings focussed on the appropriateness of maintaining, <br /> repairing and reconstructing existing non-conforming driveways as well as an apparent absence of <br /> any clear safety issues related to maintaining two curb cuts at the subject property. Based on <br /> these findings and the direction of the Council, staff has prepared Resolution 5299, a resolution in <br /> support of Mr. Tobias' appeal which in effect overturns the decision of the Planning Commission. <br /> This resolution has been reviewed and approved as to form by the City Attorney. <br /> Recommendation: <br /> Approve Resolution 5299, a resolution granting an appeal in favor of Mr. Tobias in the matter of <br /> his variance request to maintain two driveways at 8111 Eastwood Road. <br /> James Ericson, Planning Associate <br /> N:\DATA\GROUPS\COMDEV\DEVCASES\535-98\APPEAL3.RPT <br />
