Item No. <br /> Staff Report No. <br /> Meeting Date: January 25, 1999 <br /> Type of Business: CA <br /> WK: Work Session;PH:Public Hearing; <br /> CA:Consent Agenda;CB:Council Business <br /> City of Mounds View Staff Report <br /> To: Honorable Mayor and City Council <br /> From: James Ericson, Planning Associate <br /> Item Title/Subject: Consideration of Resolution 5306, a Resolution Authorizing the <br /> Acquisition of a Use Deed from Ramsey County for Drainage <br /> Purposes on a Tax-Forfeit Property, Legally-Described as Lot 3, <br /> Block 3, Greenfield Ponds. <br /> Date of Report: January 20, 1999 <br /> Background: <br /> From time to time, the County notifies all municipal jurisdictions within its boundaries of <br /> properties whose ownership have reverted back to the State for failure to pay property taxes. <br /> These properties are referred to as "tax-forfeited properties." <br /> Recently the City became aware of three properties that are tax-forfeited, all of which are in the <br /> same Greenfield Ponds development. Two of the properties (Outlots A and B), because they are <br /> completely within a wetland, are protected and controlled by the City by means of a dedicated <br /> drainage and utility easement. The third property--Lot 3, Block 3--is partially within the wetland <br /> and is not covered in its entirety by an easement, even though the property serves an important <br /> passive drainage purpose. <br /> The City has the opportunity to acquire a use deed over the third property which would guarantee <br /> in perpetuity the continued use of this property for drainage purposes. The cost of this use deed <br /> would be less than$300. A second, more costly option would be to acquire the property <br /> outright, at an appraised-value likely in excess of$10,000. The use-deed would confer to the City <br /> the same level of control as would outright ownership, the limitation being that the property <br /> would have to be used for the purpose presented in the application.
