Danielson Minor Subdivision <br /> 8444 Greenwood Drive <br /> January 25, 1998 <br /> Page 2 <br /> County. Staff has sent a copy of the survey to the City Attorney for his comments and to arrange <br /> for the drafting of easement documents to convey the drainage and utility easements as shown on <br /> the survey. <br /> Discussion: <br /> As with any subdivision of land within the City, two issues need to be addressed: dedication of <br /> easements and park dedication requirements. With regard to easements, the City Attorney has <br /> drafted easement documents to convey the easement areas shown on the certificate of survey to <br /> the City for drainage and utility purposes. These documents will need to be recorded along with <br /> the resolution of approval and the certificate of survey with Ramsey County for this subdivision to <br /> be approved by the City. <br /> Section 1204.02 of the Municipal Code addresses the park dedication requirements applicable <br /> with subdivisions of land. Because the area to be subdivided is greater than one acre, the Code <br /> specifies that a ten percent (10%) park dedication fee is required to be paid before the subdivision <br /> can be approved. According to the Ramsey County assessor's records, this land is valued at <br /> $47,700. Ten percent of that would amount to $4,470. Subdivision 3 of this Section, however, <br /> allows for the exclusion of the land under the existing home--if one exists--from the dedication <br /> requirements. Since there is an existing home, with this exclusion, the dedication requirement <br /> would be reduced 66 percent to $1,475. This amount will need to be paid before the Mayor and <br /> City/Clerk Administrator sign the Certificate of Survey and the resolution of approval. <br /> The Planning Commission, on January 6, 1999, approved Planning Commission Resolution No. <br /> 567-99, which recommended to the City Council that this minor subdivision, as requested by Dan <br /> Danielson, be approved, subject to the stipulations present in Resolution 5305. <br /> Recommendation: <br /> Approve Resolution 5305, a resolution approving this minor subdivision request subject to <br /> stipulations. <br /> James Ericson, Planning Associate <br /> Attachments: <br /> 1.
