Community Center-The entire Mounds View Community Center, including the Center <br /> and the Facility,as well as the kitchen,day care center and community education area. <br /> 4. Elegant Thymes Catering(ETC)-Elegant Thymes Catering,a division of Royal Fare <br /> Food Emporium,L.L.C. <br /> 5. Facility -The banquet hall portion of the Mounds View Community Center. <br /> ARTICLE II:TERMS AND CONDITIONS OF AGREEMENT <br /> The initial term of this Agreement will be two(2)years,commencing on January 1, 1999 and <br /> continuing through December 31,2000. This Agreement shall automatically renew annually <br /> thereafter under the same terms and conditions unless either party gives written notice of <br /> termination to the other parry on or before September 30,2000 or on or before September 30th in <br /> any subsequent year of any additional term of the Agreement; such termination may be made by <br /> either party without penalty or cause. <br /> ETC shall have the exclusive right to provide catering and food services at the Facility,except as <br /> follows: <br /> 1. If users are not using the food or catering services of ETC,such users can provide their <br /> own beverages and deserts,however,they will not be allowed to use any of the equipment <br /> or supplies of ETC without the written consent of ETC.Any such user will be responsible <br /> for set up and clean up for their event. <br /> 2. Weekday daytime users of the lounge/senior center can prepare or have prepared by other <br /> sources, any food product,however,they will not be allowed to use any of the equipment <br /> or supplies of ETC without the written consent of ETC.Any such user will be responsible <br /> for set up and clean up for such event. <br /> 3. City sponsored recreation events in the lounge/senior center,lobby,meeting room or <br /> gymnasium can prepare or have prepared by other sources, any food product,however, <br /> they will not be allowed to use any of the equipment or supplies of ETC without the <br /> written consent of ETC.Any such user will be responsible for set up and clean up for <br /> such event. <br /> 4. The City is allowed to have vending sales from a source other than ETC in the lobby area <br /> of the Center. <br /> ARTICLE III: COMPENSATION <br /> ETC shall prepare an invoice for services to be provided for each event as soon as practicable <br /> after an event has been scheduled, and remit said invoice to the City.
