All linens,china,flatware, serving pieces,etc.necessary to provide catering <br /> services to groups of up to 350. <br /> b. An under sink dishwasher in the kitchen area. <br /> c. Coffee brewing equipment. <br /> Upon mutual written consent of both ETC and the City,the City may enter into a lease <br /> arrangement for any of the items noted above, and ETC will reimburse the City for the <br /> cost of any such lease within ten business days from the earlier of the date the City <br /> receives an invoice or is required to make payment on any such lease. <br /> 11. Operate and provide the catering and food services in accordance with all federal,state, <br /> and local laws,regulations,ordinances, and City policies. ETC will obtain all permits, <br /> licenses, and certifications necessary to ensure compliance with all federal,state and local <br /> laws,regulations and ordinances. <br /> 12. Affirms, that to the best of its knowledge,its involvement in this Agreement does not <br /> result in a conflict of interest with any party or entity,which may be affected by the terms <br /> of this Agreement. ETC agrees that,should any conflict or potential conflict of interest <br /> become known,ETC will immediately notify the City of the conflict or potential conflict. <br /> B. The City's Duties and Responsibilities. The City agrees to provide the resources to <br /> maintain the Facility and associated equipment- In addition,the City agrees to do the following: <br /> 1. Maintain liability insurance in accordance with limits established by Minnesota statutes. <br /> 2. Provide and maintain the following equipment at the Facility for use by ETC: <br /> a. Ice machine; <br /> b. Refrigerator, <br /> c. Designated area for storage of linens,china,flatware,serving pieces,etc.; and <br /> d. Kitchen facilities as they presently exist at the facility. <br /> 3_ Provide access for events to ETC for the following: <br /> a. Banquet room,kitchen, and storage area; <br /> b. Tables and chairs. <br /> 4. Ensure that the Facility is cleaned and set up for the event. <br /> 5_ Provide general custodial services and maintenance for the Facility,other than the service <br /> required to be provided by ETC in Article III,Section 9,and agree to keep the Facility <br /> and related equipment in good repair. <br /> SJR-1553119 5 <br /> MU205-a <br />
