MSP Rezoning& CUP <br /> August 23, 1999 <br /> Page 5 <br /> allowed on Mounds View Drive, the limited visibility associated with the curve of the street <br /> creates an unsafe condition which would be avoided with the overflow parking at Silver View <br /> Plaza. <br /> Access: <br /> The site plan before Council represents the wishes of the Staff, the Planning Commission, and <br /> residents of the area. One issue of concern was that there be two access points for this property <br /> to promote a better circulation and to facilitate emergency vehicle and truck movement. Because <br /> of the median between the eastbound and westbound lanes of County Road I in front of the <br /> subject property, access to the site from County Road I would be limited to only those eastbound <br /> vehicles. It was thought, then, that the access from Mounds View Drive should be made as an <br /> "entrance only" with the access onto County Road I be designated as "exit only". The anticipated <br /> number of vehicles added to Mounds View Drive as a result of this facility is expected to be low-- <br /> less than one hundred per day. <br /> Sidewalks: <br /> An issue was raised concerning a sidewalk on the property to allow for circulatory walking for <br /> residents and their guests, as well as to provide a paved access for people parking at Silver View <br /> Plaza during peak periods. Because the applicant does not control either the Silver View Plaza or <br /> SuperAmerica properties, there can be no requirement to install a walking path to connect to the <br /> subject parcel. The Council can, however, direct the applicant to at least discuss this possibility <br /> with the affected property owners. While this issue would be more appropriately discussed as <br /> part of the Development Review process, because a conditional use permit is being sought, a <br /> requirement can be placed upon the CUP to require sidewalk installation. The development <br /> review would identify in exact terms the location(s) of the sidewalk. <br /> Other Considerations: <br /> Because of the amount of research compiled, publication requirements and discussions held with <br /> the Planning Commission, this request will need final action no later than September 27, 1999, the <br /> last regular meeting before the 120-day deadline of October 2, 1999. <br /> Options for Action: <br /> A. If the Council determines that there is just cause and support to approve a conditional use <br /> permit and rezoning for this development proposal, the following would need to occur: <br /> 1. Direct staff to draft Resolution 5345, a resolution approving of a conditional use <br /> permit to operate a 48-room, senior assisted living residential facility, with <br /> stipulations if any are necessary. <br /> 2. Open the public hearing and introduce the first reading of Ordinance 631, an <br /> ordinance rezoning property located at 2670 County Road I from B-2, Limited <br /> Business Commercial, to R-4, High Density residential, either as presented or as <br /> amended. <br />
