AGREEMENT FOR BUILDING INSPECTION SERVICES <br /> This Agreement is made and entered into this 12th day of April, 1999,by and between the <br /> CITY OF MOUNDS VIEW,MINNESOTA, a municipal corporation, 2401 Highway 10,Mounds <br /> View, MN 55112 (hereinafter referred to as the "Municipality") and the SPRING LAKE PARK- <br /> BLAINE-MOUNDS VIEW FIRE DEPARTMENT, INC., a Minnesota non-profit corporation <br /> . (hereinafter referred to as the "Fire Department"). <br /> WITNESSETH <br /> WHEREAS,the Fire Department renders fire protection and related services to the Cities of <br /> ,Mounds View, Spring Lake Park and Blaine,Minnesota, and is willing to provide certain building <br /> inspection and plan review services to the Municipality in furtherance of its public duties; and <br /> WHEREAS, the Municipality wishes to engage the Fire Department to provide building <br /> inspection and plan review duties which the parties acknowledge will result in the rendition of <br /> essential public.services; <br /> NOW, THEREFORE, in consideration of the foregoing agreements and mutual covenants <br /> contained herein, and the consideration hereinafter set forth,the parties hereto agree as follows: <br /> ARTICLE I. PURPOSE AND SCOPE <br /> 1.1 Subject to the terms and conditions of this Agreement, the Fire Department agrees <br /> to provide building inspection and plan review services in accordance with Minnesota Statutes § <br /> 16B.65 within the corporate limits of the Municipality (the "Territory") to the extent and in the <br /> manner as hereinafter set forth. <br /> 1.2 Neither the Municipality nor the Fire Department shall,by virtue of entering into this <br /> Agreement or rendering services hereunder,be deemed to waive as to any property owner, lessor, <br /> • lessee or any other third party any limitations on or immunities from liabilities set forth in Minnesota <br /> Statutes Chapter 466 or to which the Municipality or the Fire Department or any of their respective <br /> elected officials, officers, employees, agents or representatives may otherwise be entitled: <br /> ARTICLE II. TERM <br /> 2.1 This Agreement shall commence on the date hereof and shall continue in effect until <br /> December 31,2001 (the"Term"),unless otherwise terminated,extended or amended as hereinafter <br /> provided. <br /> ARTICLE III. SERVICES <br /> • <br /> It is the intention of the parties hereto that the Fire Department shall perform the duties <br /> normally performed by a city building inspector which duties are acknowledged by the Municipality <br /> and the Fire Department to serve an essential public function. In accordance therewith, the <br /> Municipality agrees to purchase and the Fire Department agrees to furnish the following services: <br /> Doc# 1100691\7 <br />
