He stated he had just <br /> received his notification that date, and if it could be received a day or two earlier, it would help <br /> to bring people in to the meetings. <br /> Mayor Coughlin stated a public hearing to discuss the matter had been held several months prior, <br /> and the notices were sent out at that time. He stated he had also corresponded with Mr. Sonterre <br /> in this regard. <br /> Mr. Doran thanked the Council for their time. Mayor Coughlin thanked Mr. Doran for his <br /> comments. <br /> There were no further requests or comments from the floor. <br /> 10. COUNCIL BUSINESS <br /> A. Public Hearing and Second Reading of Ordinance 635, an Ordinance to <br /> Enact a New Chapter of the Mounds View Code of Ordinances to Administer <br /> and Regulate the Location, Relocation, Installation and Reinstallation of <br /> Facilities in the Public Right-of-Way in the public Interest. <br /> Mayor Coughlin opened the Public Hearing for Items 10 A and 10 A-1, at 8:10 p.m. <br /> City Administrator Whiting stated there are three related ordinances on the agenda that evening, <br /> including the added agenda item 10 A-1, Ordinance 630. He explained that Item A is the Public <br /> Hearing and Second Reading of Ordinance 635, and after the public comment is taken, if the <br /> Council so chooses, they would vote to adopt this ordinance. <br /> City Administrator Whiting stated the same condition exists for Item C on the agenda, which is <br /> indicated as the Public Hearing and First Reading of Ordinance 640, however, is actually the <br /> Second Reading. He noted Item 10 A-1 is the Second Reading and continuation of the Public <br /> Hearing of Ordinance 630. <br /> City Attorney Long stated the ordinances presently before the Council had been discussed at <br /> several meetings. He explained Ordinance 630, the right-of-way ordinance, is the City's general <br /> right-of-way authority, and is modeled after the model right-of-way ordinance compiled by the <br /> League of Minnesota Cities. He explained that this ordinance provides cities more control over <br /> issues relating to the rights-of-way, including the recovery of cost to the taxpayers which might <br /> occur with the degradation of roads due to utilities, cable television companies, and other similar <br /> service providers. He explained that the Legislature had provided this to the cities as their <br /> authority to maintain some control over what goes into the right-of-way. He stated that Item <br /> 10A, Ordinance 635, is related in terms of providing the City authority to require a utility to <br /> underground their services. He explained that the adoption of Ordinance 635 would provide the <br /> City the authority to require undergrounding, however, the City would not be obligated to do so. <br /> City Attorney stated Item 10C, Ordinance 640, was an ordinance amending Title 900 in different <br /> areas, to make it consistent with the other two proposed ordinances, and is basically an <br /> housekeeping item, once the first two ordinances are adopted. <br />
