The area of the subject property--an interior lot--is approximately 38,115 square feet, <br /> nearly an acre. The house is set back approximately 85 feet from the street, with the detached <br /> garage situated alongside the home on the south side of the property. The house, at <br /> approximately 1,400 square feet, is presently larger than the existing 720 square-foot, two-stall <br /> garage. The applicant proposes to replace the garage in the exact same location and construct a <br /> 320 square-foot addition to the rear of the new garage to be used for a storage, or perhaps a <br /> workshop or hobby area, bringing the total proposed square-footage of the garage to 1,040 <br /> square feet. A Conditional Use Permit is required because the garage would be larger than 952 <br /> square feet. <br /> Analysis: <br /> Dimensional Criteria <br /> All of the dimensional criteria associated with this request--setbacks, spacing between buildings, <br /> width of the garage and expansion, and the numbers of doors--satisfy the requirements as stated in <br /> Chapter 1104 of the Zoning Code. The proposed expansion would be about constructed at the <br /> rear of the garage, hidden from public view. The location of the existing garage from the south <br /> property line is five feet, while the expansion area would be seven feet from the south lot line, 125 <br /> feet from the rear lot line, and over 125 feet from the north lot line, as shown in the site plan <br /> provided by the applicant. The to-be-replaced garage and proposed addition would comprise less <br /> than five percent of the rear yard area. The maximum coverage allowed is 20 percent. <br /> Adverse Effects and CUP Criteria <br /> The City Code, in Section 1125.01, Subd. 1 states that the shall examine the possible adverse <br /> effects of a conditional use permit request prior to taking action on the request.
