Item No. <br /> Staff Report No. <br /> Meeting Date: <br /> Type of Business: <br /> WK: Work Session;PH:Public Hearing; <br /> CA:Consent Agenda;CB:Council Business <br /> City of Mounds View Staff Report <br /> To: Honorable Mayor & City Council <br /> From: James Ericson, Planning Associate <br /> Item Title/Subject:- Discussion Concerning the Proposed Revisions to Ordinance 640, <br /> an Ordinance Amending Title 900, Chapter 902 of the Mounds. <br /> View Municipal Code Relating to Driveways and Repealing <br /> Provisions of Chapter 902 Relating to Street Openings <br /> Date of Report: September 29, 1999 <br /> Background: <br /> This ordinance has been before the Council on two prior occasions, once for its first reading on <br /> August 23, 1999 and again for the second reading on September 13, 1999, at which time the <br /> Council moved to continue the second reading to a date in the future, directing staff to include a <br /> provision regarding nonconforming curb cuts. <br /> Discussion: <br /> The attached ordinance is substantially the same as what has been before the Council previously, <br /> with two exceptions. First, language has been added on Page 2 which addresses non-conforming <br /> curb cuts. It reads as follows: <br /> Subd. 2. Existin•, Non-conforming Driveways:Permanent-surfaced drivewa s which do not <br /> conform to the City Code may be rebuilt, reconstructed or replaced in the same manner, <br /> fashion and location as before unless the location of said driveway poses a significant <br /> public safety hazard. If a requested building permit is denied due to the presence of such <br /> a public safety hazard the applicant may appeal the decision in writin to the City <br /> Council. For the purpose of this subdivision, a permanent surface shall mean <br /> bituminous, concrete or brick. (Ord. 640, 10/11/99) <br /> The other changes do not relate to the intent of the ordinance, but does take into consideration a <br /> previous ordinance (Ordinance 620, passed 7-27-98), which had renumbered the Subdivisions of <br /> former Section 902.05 (now 902.03.) These changes do not appear as typical changes (struck out <br /> and underlined text) as the previous versions of Ordinance 640 referenced an outdated Code <br /> section. Also, under the driveway construction section of this chapter, and addition has been <br /> made of other acceptable material regarding gravel areas. Last, under curbing standards, <br /> changes are made to the types of curbing required to reflect our current policies. <br />
