The last version of the ordinance added language pertaining <br /> to non-conforming driveways. <br /> Discussion: <br /> Given your familiarity with this ordinance and because no changes have been made since its <br /> presentation to the Council on October 4, 1999, staff is electing to save a tree and not include it <br /> with your report. If there are any questions about the ordinance, please bring the version <br /> distributed with your October 4th packet. To refresh your memory, the language concerning non- <br /> conforming driveways is as follows: <br /> Subd. 2. Existing,Non-conforming Driveways:Permanent-surfaced driveways which do not conform to the <br /> City Code may be rebuilt, reconstructed or replaced in the same manner,fashion and location as <br /> before unless the location of said driveway poses a significant public safety hazard. If a requested <br /> building permit is denied due to the presence of such a public safety hazard, the applicant may <br /> appeal the decision in writing to the City Council. For the purpose of this subdivision, a permanent <br /> surface shall mean bituminous, concrete or brick.
