/ <br /> Item No. 7 <br /> Staff Report No. <br /> Meeting Date: 12/6/99 <br /> Type of Business: WK <br /> WK: Work Session;PH:Public Hearing; <br /> CA: Consent Agenda; CB: Council Business <br /> City of Mounds View Staff Report <br /> To: Mayor and City Council Members <br /> From: Rick Jopke, Community Development Director <br /> Item Title/Subject: Ordinance No. 644 an Ordinance Amendment to Allow Billboards by <br /> Conditional Use Permit. <br /> Date of Report: December 3, 1999 <br /> Background: <br /> The City Council on November 22, 1999 gave first reading approval to Ordinance No. 644 which <br /> would allow billboards by conditional use permit on city owned property along new Highway 10 <br /> (118). The City Attorney has however advised staff that the City cannot restrict billboards to city- <br /> owned property only and that the state restricts permit issuance to commercially and industrially <br /> zoned properties. The City Council is scheduled to discuss this matter further at the December 6, 1999 <br /> work session.A public hearing on this matter is scheduled for December 13, 1999. <br /> A possible amendment to deal with the City Attorney's concern would be to change the proposed <br /> location requirement that appears in subdivision 10b as follows: <br /> The billboard must be located along ex and north of State Highway 10'118). and must be located or <br /> City owned property; <br /> This would allow billboards on the golf course and but not restrict billboards to city owned property. <br /> It would however potentially allow up to two billboards on the SYSCO property. Staff is discussing <br /> this matter further with the City Attorney's office. <br /> The Planning Commission has considered the draft ordinance to allow billboards and has passed the <br /> attached Resolution No. 597-99 recommending City Council denial of the proposed ordinance. This <br /> resolution was reviewed and approved by the City Attorney's office. The Planning Commission <br /> findings and the basis for their recommended denial are as follows: <br /> 1. Large billboard signs are not appropriate uses of property within CRP <br /> Conservation Recreational Preservation and PF Public Facilities zoning districts. <br /> These districts are intended to provide recreational opportunities, open space and <br /> protect the natural environment where possible. Large advertising signs are not <br /> consistent with that intent and are more appropriate to commercial and industrial <br /> zoning districts. <br /> 2. Large billboard signs can be visually distractive and may detract from the <br /> neighborhood and promote a negative image for the community. <br />
