RESOLUTION NO. 5401 <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION APPROVING A WETLAND BUFFER PERMIT FOR JAMIE SHARP, <br /> 2551 RIDGE LANE, PLANNING CASE 577-99 <br /> WHEREAS,Jamie Sharp has requested approval of a Wetland Buffer Permit for property <br /> of which he is the owner, legally known as: <br /> Lot 49, Block 1, RED OAK ESTATES NO. 2, Ramsey County, Minnesota <br /> WHEREAS, the above-described property is zoned R-1, Single Family Residential; and, <br /> WHEREAS, said property is located within one hundred feet of an identified wetland; <br /> and, <br /> WHEREAS, Section 1010.08 of the Municipal Code states that a Wetland Buffer Permit is <br /> required when any construction activities are planned within one-hundred feet of a wetland; and, <br /> WHEREAS,the Rice Creek Watershed District has reviewed the Delineation report <br /> prepared by Arlig Environmental,. Inc., and has found the delineation to be acceptable; and, <br /> WHEREAS, no development activities or disturbances of any kind will occur within the <br /> wetland itself; and, <br /> WHEREAS,the entirety of the proposed house and portion of the proposed attached <br /> garage encroaches into the 100-foot buffer area adjacent to the wetland; and, <br /> WHEREAS, representatives from SEH, the City's engineer, have reviewed the <br /> delineation report and have determined that the home and the resulting stormwater runoff will <br /> have a negligible impact the wetland. <br /> NOW, THEREFORE,BE IT RESOLVED that the Mounds View City Council <br /> approves the Wetland Buffer Permit for Jamie Sharp, contingent upon the following: <br /> 1. Only clean fill, substantially free of chemical pollutants and contaminants, shall be <br /> brought onto the site. <br /> 2. No waste--solid, hazardous or otherwise--shall be allowed to enter directly or <br /> indirectly into the wetland. <br /> 3. The minimum floor elevation of the home shall not be less than 895.2. <br />
