Consideration of an Amendment to the Construction and Removal <br /> Agreement entered into between the City and Property Owners of 8300 <br /> Fairchild Avenue. <br /> Community Development Director explained that the Council authorized staff to proceed <br /> through the Housing Replacement Program, to assist with the demolition of the old dwelling <br /> located at 8300 Fairchild Avenue. He indicated this was somewhat different than past practice, <br /> in that previously the City has acquired the property, cleared it, and then sold it to a developer. <br /> He explained that in this case, staff was utilizing the second option of the Housing Replacement <br /> Program, which allows the existing property owner to assist with the demolition of the old <br /> building, however, the property does not actually change hands. <br /> Community Development Director Jopke stated, in this particular case, the original agreement <br /> indicated that the City would be responsible for the demolition, and for administratively carrying <br /> it out. He explained that in this case, it made more sense for the property owner to handle the <br /> demolition, and for the City to reimburse the cost of the demolition, as long as the property <br /> owner presented staff with three bids, and the low bid was utilized, which has occurred. <br /> Community Development Director Jopke indicated the original maximum funding amount for <br /> the demolition was $15,000, and the low bid that was accepted was $8,950. He indicated that the <br /> item before the Council is an amendment to the original agreement to allow this matter to <br /> proceed, with the property owner being responsible for administering the demolition, and the <br /> City reimbursing the cost. <br /> Mayor Coughlin inquired, as this item is officially scheduled on the EDA agenda, if it would be <br /> more appropriate to recess the Council Meeting to the EDA meeting, and refer the item in <br /> question back to the Council Meeting. <br /> City Attorney Long stated this would be acceptable, however, what they were presently doing <br /> was perfectly appropriate. He explained the reason this is a City Council item, rather than an <br /> EDA item, is that the original agreement was between the City and the property owner, and <br /> therefore, the amendment was drafted with the City as a party. He advised that this item required <br /> City Council approval, and suggested the Council could take action upon the matter at this time, <br /> and remove it from the EDA agenda during the EDA meeting. <br /> Mayor Coughlin inquired, in order to provide a cleaner break, if it was the consensus of the <br /> Council to recess the Council Meeting, and open the EDA meeting. The Council agreed. <br /> Mayor Coughlin recessed the Council Meeting to the EDA meeting at 8:16 p.m. <br /> Following adjournment of the EDA meeting, Mayor Coughlin re-opened the City Council <br /> Meeting at 8:20 p.m. <br /> Mayor Coughlin stated the final item before the Council is consideration of the amendment to <br /> the Construction and Removal Agreement entered into between the City and the property owners <br /> of 8300 Fairchild Avenue. <br />
