• RESOLUTION NO. 94-EDA17 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING CONSTRUCTION PLANS FOR SILVER LAKE POINTE PROJECT WHEREAS, the Board of Commissioners (the "Board") of the Mounds View Economic Development Authority (the "Authority") entered into the Development Assistance agreement with Heartland - Mounds View Common Bond, LLC (the "Developer") approved on May 23, 1994 per Resolution No. 94-EDA 7, and WHEREAS, the Silver Lake Pointe Project (the "Project") consists of an 83-unit apartment community, 3-story elevatored building, located on a 2.7 acre parcel on County Road I and Mounds View Drive just south of Highway 10 in the City, and WHEREAS, under Section 3.3, Construction Plans, "the Authority • shall approve the Construction Plans if it determines that they conform to the applicable provisions of this Agreement; provided, however, that any such approval of the Construction Plans pursuant to this Section 3.3 shall constitute approval for the purposes of this Agreement only and shall not be deemed to constitute approval or waiver by the Authority with respect to any building, zoning or other ordinance or regulation, and shall not be deemed to be sufficient plans to serve as the basis for the issuance of a building permit if the Construction Plan are not as detailed or complete as the plan otherwise required for the issuance of a building permit. Such Construction Plans must be rejected in writing by the Authority within 10 working days of submission or shall be deemed to have been approved by the Authority.", and WHEREAS, the Developer submitted Construction Plans to the City of Mounds View Building and Engineering Department on October 31, 1994, and WHEREAS, the Authority has reviewed the Construction Plans for the Project, and WHEREAS, the Construction Plans conform to the applicable provisions of the Development Assistance Agreement by and between the • Authority and the Developer.
