J <br /> RESOLUTION NO. 95-EDA-31 <br /> • <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION APPROVING CONSTRUCTION PLANS FOR MIDWEST <br /> I.V. PROJECT <br /> WHEREAS, the Board of Commissioners (the "Board") of the Mounds <br /> View Economic Development Authority (the "Authority") entered into the <br /> Development Assistance agreement with the Bridges Leasing Co., LLC (the <br /> "Developer") approved on August 28, 1995 per Resolution No. 95-EDA-30, <br /> and <br /> WHEREAS, the Midwest I.V. Project (the "Project") consists of the <br /> construction of an approximately 30,000 square foot <br /> office/warehouse/manufacturing facility, for.Midwest I.V., manufacturer and <br /> distributor of home health care pharmaceuticals and Laser Cutting & <br /> Technology, an industrial precision laser cutting firm, on a 2.87 acres parcel on <br /> Lot 3, Block 1, North Star Industrial Park 2nd Addition, and <br /> WHEREAS, under Section 3.3, Construction Plans, "the Authority shall • <br /> approve the Construction Plans if it determines that they conform to the <br /> applicable provisions of this Agreement; provided, however, that any such <br /> approval of the Construction Plans pursuant to this Section 3.3 shall constitute <br /> approval for the purposes of this Agreement only and shall not be deemed to <br /> constitute approval or waiver by the Authority with respect to any building, <br /> zoning or other ordinance or regulation, and shall not be deemed to be sufficient <br /> plans to serve as the basis for the issuance of a building permit if the <br /> Construction Plan are not as detailed or complete as the plan otherwise required <br /> for the issuance of a building permit. Such Construction Plans must be rejected <br /> in writing by the Authority within 10 working days of submission or shall be <br /> deemed to have been approved by the Authority.", and <br /> WHEREAS, the Developer submitted Construction Plans to the City of <br /> Mounds View Building and Engineering Department on August 31, 1995, and <br /> WHEREAS, the Authority has reviewed the.Construction Plans for the <br /> Project, and <br /> • <br />
