Item No. 58 <br /> Meeting Date: 4-13-98 <br /> Staff Report No. <br /> • Type of Business: EDBA <br /> WK: Work Session;PH:Public Hearing; <br /> CA:Consent Agenda;EDBA:EDA Business <br /> Mounds View Economic Development Authority <br /> Stismaff Re ort <br /> To: Mounds View Economic Development Authority <br /> From: Steve Dorgan, Housing Inspector <br /> Title/Subject: Amendment to Purchase Agreement- 8265 Spring Lake Road <br /> Date of Report: April 9, 1998 <br /> SUMMARY <br /> At the City Council Workshop meeting last Monday,the EDA was provided information regarding <br /> discrepancies in the purchase agreement for the sale of 8265 Spring Lake Road to Preferred Builders. <br /> Preferred Builders is currently unable to obtain a building permit from the city until these discrepancies are <br /> clarified and recorded at Ramsey County. <br /> The discrepancies of the purchase agreement include: <br /> 1) An inaccurate legal description of the property in the purchase agreement. The EDA purchased the <br /> lot which included 103 feet of Lot 34(see Exhibit A). The legal description of the purchase <br /> agreement describes the property as the North 53 feet of Lot 34. The legal description needs to be <br /> amended to reflect the entire 103 feet of Lot 34. <br /> 2) An oversized utility and drainage easement along the north property line exists. The EDA <br /> established a 10 foot utility and drainage easement around the entire property when they owned it in <br /> August of 1997. Only a 5 foot drainage and utility easement is needed along the north property line. <br /> Because a 10 foot easement was established,the builder is unable to locate the garage of the home 5 <br /> feet from the property line as permitted by city code. This easement should be reestablished to 5 <br /> feet along the north property line of the lot. <br /> ACTION TO BE CONSIDERED <br /> Approve EDA Resolution No. 98-EDA-88 amending the purchase agreement between the Mounds View <br /> EDA and Preferred Builders to correct discrepancies in the legal description and utility easements for 8265 <br /> Spring Lake Road.
