Subd. 3. Temporary Non-Intoxicating 3.2 Percent Malt Liquor Special Events License. <br /> A temporary special event non-intoxicating 3.2 percent malt liquor license may <br /> be issued for the retail sale of non-intoxicating 3.2 percent malt liquor for <br /> consumption on City owned premises located at 5394 Edgewood Drive, 2401 <br /> Highway 10, and 8290 Coral Sea Street and during the time of the special <br /> Event. A special event license may be issued to a club, or charitable, religious, <br /> or other non-profit organizatio •(3) years, or to an organization contributing all of the profits of the sale of <br /> non-intoxicating 3.2 percent malt liquor to a charity, or to any business holding <br /> an on-sale license to sell non-intoxicating 3.2 percent malt liquor issued by the <br /> City or by an adjacent City. The license shall specify the date, time and place <br /> and premises of the special event. A special event 3.2 percent <br /> malt liquor license is not transferable.(Ord. 591, 10-29-96). <br /> The addition of City Hall Park to permitted premises for such a license conflicts with Code <br /> Section 909.07 Subd. 11, which prohibits alcohol in any public park or open space. This <br /> Section could be amended to allow 3.2 beer on City Hall Park property with the proper <br /> temporary license: <br /> "909.07 General Conduct <br /> Subd. 11. Alcoholic and Intoxicating Beverages: No person may possess, have within <br /> their immediate control, display, consume or use intoxicating liquor or nonintoxicating3.2 <br /> percent malt liquor in or upon any public park open space, except as permitted by <br /> temporary license pursuant to 503.03 Subd 3. This does not include the sale or <br /> consumption of alcoholic and intoxicating beverages at"The Bridges"golf course." <br /> The result of the previous changes would be to allow any club, religious, charitable or non- <br /> profit organization the ability to apply for a temporary license for functions in City Hall Park <br /> outside of the Festival in the Park Beer Garden. <br /> Option Two <br /> The previous code section changes would result in permitting alcohol in City Hall Park for <br /> other events than the Festival in the Park. The Park and Rec Commission met on Thursday <br /> night and unanimously agreed that the new ordinance should limit beer in City Hall Park to the <br /> Festival only. If Council is also interested in solely limiting alcohol to the Festival in the Park <br /> Beer Garden, a more specific municipal code section could be created. For example: <br /> 503.03: License Classifications <br /> Subd. 4. Temporary On-Sale 3.2% Malt Liquor License/ Festival In the Park <br /> Temporary on-sale 3.2% Malt Liquor licenses may be issued to a holder of an on-sale <br /> intoxicating license, 3.2% Malt Liquor license issued under Chapters 502 or 503 of the <br /> Municipal Code, or to a club, charitable organization, non-profit organization for not <br />
