DRAFT#3 <br /> DEVELOPERS AGREEMENT <br /> THIS AGREEMENT is made this day of . 1998 by and between <br /> the CITY OF MOUNDS VIEW, a Minnesota municipal corporation (the "City"), and ANTHONY <br /> PROPERTIES MANAGEMENT. INC., a Texas corporation, and LOUISE O'NEIL, an individual <br /> (collectively the "Developer"). <br /> Recitals <br /> A. The Developer is the fee owner of certain real estate located in Ramsey County, <br /> Minnesota.legally described as <br /> The southwest 'A of the northwest 14 of Section 8, Township 30, Range 23, lying <br /> southwesterly of State Trunk Highway No. 10-62, according to the United States <br /> Government Survey thereof and situate in Ramsey County, Minnesota, and all that part of <br /> the northwest 'A of the northwest '4 of Section 8, Township 30, Range 23_ lying <br /> southwesterly of State Trunk Highway No. 10, according to the United States Government <br /> Survey thereof and situate in Ramsey County.Minnesota. <br /> (hereinafter referred to as the "Property"). <br /> B. The Developer shall constrict on the Property improvements consistent with the <br /> approved site plan dated May 11. 1998 and'approved by the City Council on May 11. 1998, which <br /> involves the construction of a 2160 seat 15 screen movie theater,three (3) 11,000 square foot office <br /> buildings,a 5,000 square foot restaurant and a 6.400 square foot retail/restaurant building. <br /> C. The Developer has requested that the City approve the issuance of building permits <br /> ("Permit")for this project. <br /> D. As a prerequisite to the approval of the Permit, the City Council requires the <br /> Developer to agree to the construction of certain public improvements pursuant to this Agreement <br /> for the orderly development of the Property. <br /> E.
