RESOLUTION NO. 5288 <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION APPROVING AN AMENDED AND RESTATED <br /> INII1AL AGREEMENT, HOUSING DEVELOPMENT <br /> AGREEMENT. AND MANAGEMENT AGREEMENT FOR THE <br /> SILVER LAKE COMMONS PROJECT AND AUTHORIZING <br /> THE MAYOR AND CITY CLERK-ADMINISTRATOR TO <br /> EXECUTE THE AGREEMENTS ON BEHALF OF THE CITY'. <br /> WHEREAS, a development, known as Silver Lake Commons.was previously proposed by <br /> MSP Real Estate,Inc. (the Developer)in the City of Mounds View; and <br /> WHEREAS. such development, as proposed, required the participation of the Minneapolis <br /> Public Housing Authority, acting pursuant to a joint powers Initial Agreement and Cooperation <br /> Agreement with the City of Mounds View,as authorized by Minn. Stat. §471.59:and <br /> WHEREAS, such development required the Developer, pursuant to the Mounds View <br /> Municipal Code,to enter into a development contract with the City; and <br /> WHEREAS, Resolution No. 5198 was adopted by the City of Mounds View on <br /> December$. 1997.wherein the City Council authorized the Mayor and its City Clerk-Administrator <br /> to execute the Cooperation Agreement. Initial Agreement and Developers Agreement on behalf of <br /> the City;and <br /> WHEREAS, since the adoption of Resolution No. 5198 and the execution of the <br /> Cooperation Agreement.Initial Agreement and Developers Agreement.changes in the development <br /> necessitate the execution of an Amended and Restated Initial Agreement;and <br /> WHEREAS, such previously adopted agreements and the development necessitate the <br /> adoption of a Housing Development Agreement by and between the Minneapolis Public Authority <br /> in and for the City of Minneapolis.
