"909.07 General Conduct <br /> Subd. 11. Alcoholic and Intoxicating Beverages:No person may possess, have within <br /> their immediate control, display, consume or use intoxicating liquor or ing-3.2 <br /> percent malt liquor in or upon any public park open space, except as permitted by <br /> temporary license pursuant to 503.03 Subd 4 Temporary On-Sale License/Festival In the <br /> Park. This does not include the sale or consumption of alcoholic and intoxicating <br /> beverages at"The Bridges" golf course." • <br /> The one problematic aspect of this change would be that the ordinance would need to be <br /> amended if the name, "Festival in the Park," were to ever change. This code section would <br /> limit the temporary license to a vendor at the "Festival in the Park" only, not to another <br /> community festival with any other name. <br /> In addition to these code changes, the City could require a conditional use permit which could <br /> establish a number of requirements including crowd management, alcohol management, and <br /> enclosure of beer garden. The City may also want to have the Festival Committee sign a <br /> contract with hold harmless and indemnification provisions. . , <br /> The Festival Committee is currently looking into the costs for liability insurance for the beer <br /> 'garden. In addition, the city should obtain a rider for the beer garden through the liability <br /> insurance already in place for the Festival. According to our insurance agency, the cost of this <br /> rider would be approximately $300, which would cover the City to a maximum of$500,000.. <br /> Recommended Action: Approve the second reading and move to adopt Municipal Code Section <br /> 503.03 Subd. 4, and the changes to Municipal Code Section 909.07 Subd. 11. <br />
