Duong asked that the City Council renew <br /> his license to give him the necessary time to sell his business. <br /> Chief Ramacher told the Council that Murzyns has successfully passed a police sting operation <br /> that was staged to see if Murzyn's Liquor Store would sell cigarettes to minors. He added that <br /> Murzyns has installed a closed-circuit video system to try to document the situations that are <br /> taking place at the store. Ms. Duong does not know how to operate the video equipment. The <br /> Chief added that it would be his recommendation, based on the facts,that the renewal of the <br /> license for an Off-Sale Intoxicating Liquor License not be renewed. <br /> Attorney Long outlined the City Council's options in dealing with the matter as follows: <br /> 1. Act to renew the license and see what the outcome of court action will be on the pending <br /> cases <br /> 2. Act to not renew the license based on the information and testimony heard at the <br /> evening's meeting <br /> Jerry Linke, 2319 Knoll Drive, stated there is a third option. The third option being renewal <br /> contingent upon certain conditions of operation that would be established by the City Council. <br /> This contingency basis would give the Duongs the chance to sell their business before the June <br /> 30, 1998 expiration of their license. <br /> Attorney Long stated, in regards to the sale of the Murzyn Liquor Store, that liquor licenses in <br /> the City are not transferable. The new liquor license applicant would have to come in and apply <br /> for the license on his or her own merit. <br /> Arthur Jordan, spoke in favor of giving the Duongs an opportunity to try to operate the <br /> business without his wife, Rose Marie, being employed as the clerk. He suggested that Mr. <br /> Duong hire somebody that was familiar with working as a clerk in a liquor store. <br /> Koopmeiners closed the public hearing,and opened the Council Meeting. <br /> MOTION/SECOND: Quick/Koopmeiners to approve the recommendation of the City Attorney, <br /> to prepare the resolution to deny renewal of the Off-Sale Liquor license for Murzyn's Liquor- <br /> 2740 Highway 10. <br /> Quick told the Council that he was sympathetic to the applicants situation, but he felt there had <br /> been no lessons learned from the educational efforts of the Police Department. The City would <br /> be "playing Russian roulette with the lives of the youth in the City if the license was renewed." <br />
