Peterson Minor Subdivision <br /> Planning Case No. 527-98 <br /> July 13, 1998 <br /> Page 2 <br /> feet of frontage on Pleasant View Drive and 225 feet along County Road H. There is a home on <br /> the eastern portion of the lot. The applicant proposes to split off the west 125 feet of the lot, to <br /> create a 12,500 sf corner lot. The remaining lot would only be 10,000 sf, which is 1,000 sf less <br /> than the minimum lot size. The applicant has arranged to purchase 10 feet of property from the <br /> neighbor to the east, Mr. Steve Borden, residing at 3009 County Road H. With the additional 10 <br /> feet, the remaining property, at 11,000 sf, would meet the minimum requirements. This will be <br /> accomplished by means of a simple deeded land transfer between the two property owners. <br /> Discussion: <br /> The proposed legal descriptions and certificate of survey have been reviewed by the City's <br /> Engineering Technician, who finds them in compliance with City standards in the proper form for <br /> recording. Staff has sent a copy of the certificate of survey to the City Attorney for his comments <br /> and to arrange for the drafting of easement documents to convey the drainage and utility <br /> easements shown on the survey. These easement documents have been prepared and are <br /> attached for reference. <br /> With every subdivision of land within the City of Mounds View, a park dedication fee is required <br /> to be paid. The dedication fee for this subdivision is five percent of the market value of the land. <br /> There is an exception to this in that if a home occupies one of the remaining or created lots, the <br /> land value for that parcel is to be excluded from the fee. According to the Ramsey County <br /> assessor's records, this property is valued at $29,700. Five percent of that would amount to <br /> $1,485. With this exclusion, the dedication requirement is reduced to $825. <br /> There is an outstanding utility bill for this property that has remained unpaid since 1995. The <br /> current owners have only recently took over control of the property via a court settlement yet <br /> have indicated that they will make arrangements to meet with the utility billing clerk to work out <br /> an appropriate payment to bring the account up to date. <br /> The Planning Commission, at its meeting on June 17, 1998, approved Resolution 549-98, a <br /> resolution recommending to the City Council approval of this minor subdivision request. <br /> Recommendation: <br /> Approve Resolution 5247, a resolution approving the minor subdivision of 3025 County Road H <br /> as requested by Duane and Nancy Peterson, subject to stipulations. <br /> James Ericson, Planning Associate <br /> N:\DATA\GROUPS\COMDEV\DEVCASES\527-98\PETERSON.CC1 <br />
